Drive Roster Terms & Conditions

These Terms & Conditions govern your access to and use of Drive Roster.

Drive Roster is operated by Amanda Banks trading as Drive Roster, a sole trader.

By creating an account, subscribing to Drive Roster or otherwise using the service, you agree to these Terms.

1. About Drive Roster

Drive Roster is an online driving school management service designed for driving instructors and driving schools.

The service may include tools for managing instructors, learners, lessons, diaries, enquiries, waiting lists, payments, communications, resources and related business information.

Features may change, improve or be added as Drive Roster develops.

2. Business use

Drive Roster is primarily intended for use by driving instructors, driving schools and other users acting for purposes connected with their trade, business or profession.

By creating a business account, you confirm that you have authority to enter into these Terms either for yourself or on behalf of the organisation you represent.

Nothing in these Terms removes any legal rights that cannot lawfully be excluded.

3. Your account

You are responsible for providing accurate information when creating and maintaining your Drive Roster account.

You must keep your login details secure and must not deliberately allow another person to use your personal login unless Drive Roster provides a feature specifically intended for shared or additional-user access.

You are responsible for activity carried out through your account unless the activity results from a security failure for which Drive Roster is responsible.

If you believe your account or login details have been compromised, contact us as soon as possible at support@driveroster.com.

4. Instructor and staff accounts

Where a Drive Roster subscription permits multiple instructors or staff members, the account owner is responsible for controlling who is given access.

You must remove access when a person no longer requires it or is no longer associated with your driving school.

Each user must use their own authorised access credentials where the service provides individual user accounts.

5. Subscriptions and fees

The subscription price, billing period and features included in your chosen plan will be shown before you subscribe.

Prices may vary according to the plan selected, number of instructors, optional services or other features.

Unless stated otherwise, subscriptions will continue for the billing period selected and renew until cancelled.

We will not increase the price of an existing subscription without giving reasonable notice before the new price takes effect.

Additional third-party services, such as SMS messaging or other chargeable communications, may carry separate usage charges where clearly stated.

6. Free trials and promotional offers

Drive Roster may occasionally provide trials, introductory offers, discounts or promotional periods.

Any specific conditions applying to an offer will be shown when the offer is made.

We may limit promotional offers to new customers, particular plans or one use per customer.

7. Cancelling your subscription

You may cancel your subscription in accordance with the cancellation options available within Drive Roster or by contacting support@driveroster.com.

Unless otherwise stated when you subscribe, cancellation will normally take effect at the end of your current paid billing period.

You will continue to have access to the paid service until that period ends.

Payments already made are normally non-refundable for partially used billing periods unless required by law or we agree otherwise.

8. Your information and content

You remain responsible for information you enter into Drive Roster.

This includes learner records, instructor information, lesson notes, diary entries, payment records, enquiries, resources, messages and other content uploaded or created through your account.

You retain ownership of your own business information and content.

You give Drive Roster permission to host, copy, process and transmit that information only as reasonably necessary to provide, secure, maintain and improve the service.

9. Learner information

Where you enter information about learners into Drive Roster, you are responsible for ensuring that you have a lawful basis for collecting and using that information.

You are also responsible for ensuring that information is appropriate, relevant and reasonably accurate.

In most circumstances, the instructor or driving school determines why learner information is collected and used and will therefore act as the data controller.

Drive Roster will normally act as a data processor for that learner information.

UK GDPR requires controllers using processors to have a written contract containing specified data-protection provisions, which are incorporated into these Terms under section 20 below.

10. Sensitive information

You should only record information that is reasonably necessary for your legitimate driving instruction or business purposes.

Where information could require additional protection under data-protection law, you are responsible for ensuring that you have an appropriate lawful basis and meet any additional legal requirements before entering it into Drive Roster.

11. Acceptable use

You must not use Drive Roster to:

  • break the law or encourage unlawful activity;
  • access another user’s account without permission;
  • upload malicious software or deliberately interfere with the service;
  • attempt to bypass security controls;
  • send unlawful, abusive, threatening or unsolicited communications;
  • store information you have no lawful right to process;
  • copy, reverse-engineer or commercially exploit Drive Roster except where expressly permitted by law; or
  • use the service in a way that could materially harm Drive Roster, its users or its infrastructure.

We may restrict or suspend access where we reasonably believe these Terms have been seriously breached or where action is necessary to protect the service or other users.

12. Availability of the service

We aim to keep Drive Roster available and reliable, but no online service can guarantee uninterrupted availability.

Access may occasionally be affected by maintenance, updates, internet failures, hosting problems, third-party services or circumstances beyond our reasonable control.

Where practical, we will try to minimise disruption and provide notice of significant planned maintenance.

13. Updates and changes

Drive Roster will continue to develop.

We may add, alter, improve or remove features where reasonably necessary to improve the service, maintain security, comply with the law or respond to technical or commercial requirements.

We will not deliberately remove a fundamental paid feature without reasonable consideration of the impact on existing customers.

14. Third-party services

Drive Roster may rely on third-party providers for services including hosting, email, SMS, push notifications, payments, security and other technical functions.

Use of certain third-party features may also be subject to that provider’s terms.

We are not responsible for an external service being unavailable where the circumstances are outside our reasonable control, although we will take reasonable steps to restore affected Drive Roster functionality.

15. Intellectual property

Drive Roster, including its software, design, branding, code, documentation and original content, is owned by or licensed to Amanda Banks trading as Drive Roster.

Your subscription gives you a limited, non-exclusive, non-transferable right to use Drive Roster for your business while your account remains authorised.

It does not transfer ownership of Drive Roster or its intellectual property to you.

16. Support

Support requests can be submitted through the Drive Roster Support page or by emailing support@driveroster.com.

We will make reasonable efforts to respond to support requests, but response times are not guaranteed unless a separate service-level agreement has been agreed.

17. Suspension and termination

We may suspend or terminate access where reasonably necessary if:

your subscription remains unpaid; you seriously or repeatedly breach these Terms; your account is being used unlawfully; continued access creates a material security risk; or we are legally required to do so.

Where appropriate, we will normally give you an opportunity to resolve the issue before permanently terminating an account.

You may stop using Drive Roster and cancel your subscription at any time subject to the subscription provisions above.

18. Your data when you leave

Where reasonably practicable, we will provide an appropriate way for you to export or obtain relevant business data before or following termination.

After the applicable account-retention period, information processed on your behalf may be deleted or anonymised unless we are legally required to retain it.

Backup copies may remain temporarily within secure backup systems until they are overwritten through our normal backup cycle.

19. Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Drive Roster is a business-management tool. You remain responsible for your driving instruction, business decisions, diary management, regulatory responsibilities, learner communications and the accuracy of information entered into the system.

To the fullest extent permitted by law, we will not be liable for indirect or consequential losses, loss of profit, loss of anticipated savings, loss of business opportunity or losses resulting solely from circumstances outside our reasonable control.

Where liability can lawfully be limited, our total liability arising from the service during any 12-month period will not normally exceed the subscription fees paid by you to Drive Roster during that same 12-month period.

20. Data Processing Terms

Where Drive Roster processes personal data on your behalf, you are the Controller and Amanda Banks trading as Drive Roster is the Processor for that processing.

The processing covers personal data entered into or generated through Drive Roster for the duration of your use of the service.

The purpose of processing is to provide and operate the Drive Roster service on your behalf.

Data may include learner and instructor names, contact details, addresses, lesson information, diary information, notes, payment records, messages, enquiries, account information and other information you choose to enter into the service.

Data subjects may include learners, prospective learners, instructors, staff and other individuals whose information you legitimately manage through Drive Roster.

Drive Roster will:

process personal data only on your documented instructions unless otherwise required by UK law; ensure people authorised to process the information are subject to appropriate confidentiality obligations; implement appropriate technical and organisational measures designed to protect the information; assist you reasonably with requests from individuals exercising their data-protection rights; provide reasonable assistance concerning security obligations, personal-data breaches and data-protection impact assessments; and provide information reasonably required to demonstrate compliance with applicable processor obligations.

These are among the mandatory contractual requirements for controller/processor agreements under Article 28 UK GDPR.

Sub-processors

You give Drive Roster general authorisation to use appropriate sub-processors where reasonably necessary to provide the service.

These may include providers of hosting, email, messaging, payments, security and other technical services.

We will ensure that relevant data-protection obligations are imposed on sub-processors through appropriate contractual arrangements.

Where required, we will provide reasonable notice of material changes to sub-processors and consider reasonable objections made on genuine data-protection grounds. UK GDPR requires processor-to-sub-processor contracts to provide equivalent protection for the personal data involved.

International transfers

Where a provider processes personal information outside the United Kingdom, Drive Roster will use appropriate safeguards where required by applicable UK data-protection law.

End of processing

At the end of the service, Drive Roster will, subject to reasonable technical limitations and legal retention requirements, delete or return personal data processed on your behalf.

Information retained temporarily in backups will remain protected and be deleted through the normal backup lifecycle. Article 28 specifically requires processor contracts to address deletion or return of personal data when processing ends.

21. Privacy

Our Privacy Policy explains how Drive Roster handles personal information where we act as a data controller ourselves, including account, support and website information.

These Terms and the Privacy Policy should be read together.

22. Changes to these Terms

We may update these Terms where necessary because of changes to Drive Roster, applicable law, security requirements or the way the service operates.

Where a change materially affects an existing paid subscription, we will provide reasonable notice where practicable.

Continued use of Drive Roster after revised Terms take effect will constitute acceptance of the updated Terms where permitted by law.

23. Governing law

These Terms are governed by the laws of England and Wales.

The courts of England and Wales will have jurisdiction over disputes arising from these Terms, subject to any mandatory legal rights that apply.
